If you participate through an organization, the organization manages your subscription and sets its own usage policy, but does not automatically receive your performance data.
- How do we keep your information safe? We have organizational and technical measures in place, though no system is perfectly secure.

1. WHAT INFORMATION DO WE COLLECT?
Personal information you disclose to us. We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us. This may include:
- Names
- Phone numbers
- Email addresses
- Mailing and billing addresses
- Usernames and passwords
- Contact preferences
- Debit/credit card numbers (handled by our payment processor — see below)
- Date of birth
- Gender
User Content. The Services are built around content you create and upload. This includes:
- Video footage you upload as local files or link from third-party platforms (such as YouTube or Twitch). This footage may depict you and other identifiable individuals.
- Markings, tags, and event data you create while analyzing footage.
- Session reports and performance analytics generated from your Markings.
Sensitive Information. We do not intentionally process sensitive information. You should not upload footage or other content for the purpose of collecting sensitive information about any individual.
Payment Data. We may collect data necessary to process your payment if you choose to make purchases. All payment card data is handled and stored by Stripe. You may review Stripe's privacy notice at https://stripe.com/privacy.
Information automatically collected. We automatically collect certain information when you visit, use, or navigate the Services. This information does not necessarily reveal your specific identity but may include:
- Log and Usage Data — service-related, diagnostic, usage, and performance information our servers automatically collect.
- Device Data — information about the computer, phone, tablet, or other device you use to access the Services.
- Location Data — information about your device's location, which can be either precise or imprecise.
2. HOW DO WE PROCESS YOUR INFORMATION?
We process your personal information for a variety of reasons, depending on how you interact with our Services, including:
- To facilitate account creation, authentication, and account management.
- To deliver and facilitate delivery of the Services, including storing and processing your User Content so you can analyze your performance.
- To enable sharing of your clips and session reports with other users you choose.
- To respond to user inquiries and offer support.
- To send administrative information to you.
- To fulfill and manage your orders and subscriptions.
- To enable user-to-user communications.
- To request feedback.
- To send you marketing and promotional communications (with your consent where required).
- To protect our Services from fraud and misuse.
- To identify usage trends and improve our Services, including by creating aggregated and de-identified data.
3. WHAT LEGAL BASES DO WE RELY ON?
We only process your personal information when we believe it is necessary and we have a valid legal reason to do so. Depending on applicable law, we may rely on consent, performance of a contract, legitimate interests, legal obligations, and vital interests as legal bases. You can withdraw consent at any time.
4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?
We may share your personal information in the following situations:
- Service providers (sub-processors). We share information with third-party vendors and service providers that perform services for us and require access to such information to do that work. These include:
- Amazon Web Services (AWS) — cloud hosting and video storage (United States).
- Stripe — payment processing.
- Google Analytics — analytics for our marketing website.
- Email and communications providers (including AWS SES).
- Other users you choose to share with. Sharing is opt-in for both sides. When you send clips or session reports to another user via "Add a Friend" or "Squads," that recipient can view what you shared; recipients are added only after they approve, and can reject or later remove shared content.
- Organizations. If an organization (such as a school, club, or team) purchases or manages your subscription, the organization manages seats and sets its own usage policy, but does not automatically receive your footage, Markings, or performance data. Your data is shared with coaches or teammates only when you choose to share it, or as required by the organization's own policy.
- Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business.
- Legal and safety. We may disclose information where required by law or to protect rights, safety, and our Services.
We post product updates and "what's new" announcements on our Discord community, but we do not share any user's personal data, names, or performance data — whether of organizations or individuals — on Discord.
5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?
We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some help us maintain security, prevent crashes, fix bugs, save your preferences, and provide basic site functions. We also permit third parties and service providers to use online tracking technologies for analytics.
Google Analytics. We may share your information with Google Analytics to analyze use of the Services. To opt out, visit https://tools.google.com/dlpage/gaoptout.
6. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?
Our servers are located in the United States. Regardless of your location, your information may be transferred to, stored by, and processed by us and the third parties with whom we share it, including in the United States and other countries. If you are in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses for such transfers.
7. HOW LONG DO WE KEEP YOUR INFORMATION?
We keep your personal information only for as long as necessary for the purposes set out in this Privacy Notice, unless a longer period is required or permitted by law. See Section 14 for retention of User Content and video footage.
8. HOW DO WE KEEP YOUR INFORMATION SAFE?
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, no electronic transmission or storage technology can be guaranteed to be 100% secure.
9. DO WE COLLECT INFORMATION FROM MINORS?
The Services are intended for users aged 13 and older. We do not knowingly collect personal information from children under 13. Users aged 13–17 require a parent or guardian to provide their details and consent to the minor's use of the Services, and to supervise that use. Users aged 18 and over may use the Services independently. Where minors participate through a school or organization, that organization is responsible for obtaining any consents required under applicable law (including, in the United States, COPPA and, where applicable, FERPA). If you believe we have collected information from a child under 13, please contact us at support@fantasticwe.com and we will take steps to delete it.
10. WHAT ARE YOUR PRIVACY RIGHTS?
Depending on your location (for example, the EEA, UK, Switzerland, and Canada), you may have rights including the right to: request access to and a copy of your personal information; request rectification or erasure; restrict or object to processing; data portability; and the right not to be subject to solely-automated decision-making. Account Information. You can review or change your account information, or terminate your account, by logging into your account settings or contacting us.
11. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers include a Do-Not-Track ("DNT") feature. We do not currently respond to DNT signals because no uniform technology standard has been finalized.
12. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and details about the personal information we maintain, to correct or delete it, to obtain a copy, to opt out of targeted advertising or sale of personal information, and to non-discrimination for exercising your rights.
Categories of personal information we collect: identifiers (name, address, email); protected classification characteristics (gender, age, date of birth); user-generated content (video footage and performance markings); internet/usage activity; approximate geolocation; commercial/transaction information (handled by our payment processor); and inferences drawn from the above. We do not sell your personal information, we do not share it for cross-context behavioral advertising, and we do not use it for targeted advertising.

13. DO OTHER REGIONS HAVE SPECIFIC PRIVACY RIGHTS?
Australia and New Zealand. We handle personal information under Australia's Privacy Act 1988 and New Zealand's Privacy Act 2020. You may complain to the Office of the Australian Information Commissioner or the Office of the New Zealand Privacy Commissioner.
Republic of South Africa. You may request access to or correction of your personal information, and may contact the Information Regulator (South Africa) at enquiries@inforegulator.org.za.
14. DATA RETENTION POLICY
1. Marking and Event Data. We collect and store marking and event data generated by users. This data is retained even after your subscription is canceled or your account is closed. After account closure, all marking and event data is fully anonymized and may be retained in aggregated, de-identified form.
2. Personal Information. Upon account closure, we permanently delete identifying personal information (such as your name, email address, and other identifying details), subject to any retention required by law.
3. Video Storage. All user-uploaded video files are stored securely on AWS S3. When you cancel your account: if you are on a yearly subscription plan, your videos are retained for up to 30 days after cancellation; if you are on a monthly subscription plan, your videos are retained for up to 7 days after cancellation. After these periods, all videos associated with your account are permanently deleted.
15. DO WE MAKE UPDATES TO THIS NOTICE?
We may update this Privacy Notice from time to time. The updated version will be indicated by an updated "Last updated" date and will be effective as soon as it is accessible. We encourage you to review it frequently.
